7. SMS & Text Message Communications

By providing your phone number and submitting a form on our website, you consent to receive text messages (SMS) from Avonya Real Estate regarding your inquiry, property listings, market updates, transaction updates, and other real estate services.

Consent is not a condition of purchase. Message and data rates may apply. Message frequency varies based on your interactions with us and market activity.

Opting Out of SMS

We will not share your mobile phone number or SMS consent with third parties for their marketing purposes.

8. Email Marketing Communications

Please allow up to 10 business days for your opt-out to take effect. You may still receive transactional emails related to services you have requested.

These measures include SSL/TLS encryption for data transmission, access controls limiting who can view personal information, regular security assessments of our systems, and secure hosting on Cloudflare’s infrastructure.

However, no method of transmission over the internet or electronic storage is 100% secure. While we strive to use commercially reasonable means to protect your personal information, we cannot guarantee its absolute security. You provide your information at your own risk.

In the event of a data breach that affects your rights and freedoms, we will notify affected individuals as required by applicable law.

We retain your personal information for as long as necessary to fulfill the purposes for which it was collected, including to provide our services, comply with legal obligations, resolve disputes, and enforce our agreements. Specific retention periods include:

  • Contact form submissions — Retained for up to 3 years or until you request deletion
  • Transaction-related records — Retained for a minimum of 7 years as required by California real estate law
  • Marketing opt-out records — Retained indefinitely to honor your opt-out preference
  • Website analytics data — Retained for up to 26 months (Google Analytics default)
  • Agent application records — Retained for up to 2 years if not hired

When retention periods expire, we securely delete or anonymize your personal information.

Our website may contain links to third-party websites, including our MLS search platform (SaleCore / MetroList), PaymentChecker.com (mortgage calculator), social media platforms (Facebook, Instagram, LinkedIn), and other external resources.

This Privacy Policy applies only to our website. We are not responsible for the privacy practices of third-party websites and encourage you to review their privacy policies before providing any personal information. The inclusion of a link does not imply our endorsement of that site.

Our website is protected by Google reCAPTCHA. The Google Privacy Policy and Terms of Service apply to your use of reCAPTCHA.

12. Children’s Privacy

Our website and services are not directed to individuals under the age of 16. We do not knowingly collect personal information from children under 16. If you are a parent or guardian and believe that your child has provided us with personal information without your consent, please contact us at gdavidsonre@gmail.com and we will promptly delete such information from our records.

13. Do Not Track Signals

Some browsers include a “Do Not Track” (DNT) feature that signals to websites that you do not want to be tracked. Currently there is no universal standard for how websites should respond to DNT signals. Our website does not currently alter its data collection and use practices in response to DNT signals. We will update this policy if a standard is established.
